General Terms and Conditions of Sale
1 - Scope of application
These General Terms and Conditions of Sale apply, without restriction or reservation, to all commercial relations between PARFUMS DES ILES and non-professional buyers. Therefore, these buyers are required to read them carefully.
PARFUMS DES ILES, creator of the eponymous brand, is a sole proprietorship located at A 21 Gros Raisin - 97228 SAINTE-LUCE - Martinique (+596 596 62 22 90 - contact@parfums-des-iles.com ) ).
These general terms and conditions aim to define the rights and obligations of the parties involved in the online sale of goods offered by the seller to the buyer, via the website www.parfums-des-iles.com.
These General Terms and Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.
By validating an order, a customer unconditionally accepts all of these General Terms and Conditions of Sale in effect on the website www.parfums-des-iles.com on the date the order is placed.
2 - Conclusion of the contract
The contract is concluded when the ordered goods have been paid for.
When placing an order, the customer provides the following information under their sole and entire responsibility: Name, First Name, Delivery and Billing Address, Phone Number, and Email Address. In case of errors in the details provided, PARFUMS DES ILES cannot be held responsible for any delivery issues.
Confirmation of the order constitutes acceptance of these terms and conditions of sale. It is equivalent to a signature and acceptance of the transactions carried out. The sale will only be considered final after an order confirmation email has been sent to the Buyer.
3 - Right of return
Regarding the right of withdrawal: In accordance with the provisions of Article L.221-8 of the French Consumer Code, the Buyer has a 14-day working period from receipt of the products to return them to PARFUMS DES ILES for exchange or refund, provided that the products are returned in their original packaging and in perfect condition. Damaged, soiled or incomplete items will not be accepted.
If this deadline falls on a Saturday, Sunday, or public holiday, it is postponed to the next business day.
The buyer exercises this right of withdrawal by sending an email to contact@parfums-des-iles.com , clearly specifying the intention to exercise this right of withdrawal and requesting a return authorization. The buyer must also attach the corresponding invoice to this message.
The Buyer may use the withdrawal form in the appendix.
However, the return costs are the sole responsibility of the Buyer. The exchange (subject to availability) or refund will be made within 10 days of PARFUMS DES ILES receiving the items returned by the Buyer.
If the customer does not opt for an exchange, the purchase price and delivery costs will be refunded.
Under the legal guarantees: PARFUMS DES ILES guarantees the conformity of the goods to the contract, allowing the Buyer to make a claim under the legal guarantee of conformity provided for in articles L. 217-4 and following of the Consumer Code or the guarantee for defects in the goods sold within the meaning of articles 1641 and following of the Civil Code. In the event of the implementation of the legal guarantee of conformity, it is recalled that:
-The Buyer has a period of 2 years from the delivery of the goods to take action;
-The Buyer may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-17 of the Consumer Code;
-The Buyer is exempt from providing proof of the existence of the non-conformity of the goods during the 24 months following the delivery of the goods.
Any reservations or claims for non-conformity or defects in the delivered products must be made by postal mail to PARFUMS DES ILES - A 21 Gros Raisin - 97228 SAINTE-LUCE - Martinique or by email to contact@parfums-des-iles.com with all supporting documentation.

4 - Rates
The prices of our products are in euros, all taxes included.
The prices applied are those in effect on the parfums-des-iles-martinique.com website on the day the order is placed. These prices are subject to change during their validity period, as indicated on the PARFUMS DES ILES website, creator and owner of the PARFUMS DES ILES brand.
In addition to the sale price, processing, shipping, transport, delivery and packaging fees will be added. The products remain the property of PARFUMS DES ILES until full payment of the price, regardless of the delivery date of the product.
5 - Payment Terms
The price is payable in full upon placement of the order by the Buyer, via secure payment by credit card or bank transfer. PARFUMS DES ILES shall not be obliged to deliver the products ordered by the Buyer if the latter does not pay the full price.
Credit card payments are charged at the time of ordering.
Payments made by the Buyer will only be considered final after the sums due to the company PARFUMS DES ILES have been effectively received.
If the credit card becomes invalid at any time during the purchase period, or if the debit is refused for any reason, the Seller will send an email to the customer at the address associated with the customer account, stating that the purchase has been interrupted and requesting the customer to update their payment information. The purchase will be suspended and no additional orders will be processed or shipped until this information has been updated to allow payment for the initial order.
The Seller provides the buyer with a copy of the invoice, which is delivered via the website after payment.
In the event of non-payment, the sale will be automatically terminated.
PARFUMS DES ILES reserves the right, in the event of non-compliance with the payment terms set out above, to suspend or cancel the delivery of current orders placed by the Buyer.
The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as evidence.
6 - Deliveries
Delivery Areas: Worldwide
PARFUMS DES ILES primarily uses Colissimo Suivi for shipping. As soon as the package is handed over to this service, the customer immediately receives an informational email containing the package tracking number, which can be used to track the package on the La Poste website: http://www.coliposte.net.
PARFUMS DES ILES is committed to dropping off the package at the Post Office within 72 hours.
This service offers the possibility of collecting ordered products from a post office near the delivery address in case of absence from the initial delivery location when the postman calls. Thanks to a delivery notice left in the mailbox, the customer can collect their parcel at the post office during opening hours, within 15 days.
As of today, La Poste (the French postal service) states, via Colissimo, that the delivery time from Martinique is 5 to 10 days.
In case of delivery delay or product loss, the customer must report it by phone or email so that PARFUMS DES ILES can contact the Post Office.
A postal investigation can last up to 21 days from the start date of the investigation. If, during this period, the product is found, it will be immediately redirected to the customer's home. If, on the other hand, the product is not found after the 21-day investigation period, the Post Office considers the package lost. Only at this point will PARFUMS DES ILES be able to send a replacement product, at its own expense. If the ordered product(s) are no longer available on that date, a refund of the purchase price will be made. If the product(s) are still available but have changed in price on the website, PARFUMS DES ILES will apply the new selling prices, either by refunding the difference by check or by requesting a supplementary check for this price difference.
PARFUMS DES ILES declines all responsibility for any delays in delivery due to the carrier, particularly in the event of loss of products or strikes.
The rates we indicate are those currently in effect at the Post Office for delivery via Colissimo.
For shipments outside mainland France, the international postal rate applies and the shipment is made via international registered mail requiring a signature. PARFUMS DES ILES reserves the right to add insurance, at its own expense, for order amounts of 100 euros or more. Packages are shipped via La Poste's Colissimo service. Items are delivered to the shipping address provided during the order. The shipment will be confirmed to the customer on the day of dispatch by email, provided the customer has correctly provided their email address. Shipping costs are the responsibility of the customer. Shipping costs are clearly displayed on the order form before confirmation by the customer, except in special cases.
If the package is not delivered directly, a notice of availability is issued by the carrier.
If the package is not collected within the allotted time, it will be returned to PARFUMS DES ILES. In this case, it can be reshipped to the customer, provided that the customer pays the shipping costs again.
Any package returned to the Seller due to an incorrect or incomplete delivery address will be reshipped at the buyer's expense.
Since transport is at the seller's risk, the customer is advised to check the packages upon arrival. In case of apparent defects, the Customer benefits from the right of return specified in Article 3. The deadlines indicated at the time of ordering are given as an indication and may vary depending on the destination. PARFUMS DES ILES undertakes to deliver the products ordered by the Buyer as quickly as possible. Delivery times are given as an indication and any delay will not give rise to any damages, retention or cancellation of the order by the Buyer. Except in special cases or unavailability of one or more products, the ordered products will be delivered in one go.
However, if the ordered products have not been delivered within a reasonable time after the indicative delivery date, or for any reason other than force majeure, the sale may be terminated at the written request of the Buyer to PARFUMS DES ILES. The sums paid by the Buyer will then be refunded without delay, excluding any compensation or withholding. Delivery is deemed to have been completed upon delivery of the ordered products by PARFUMS DES ILES to the carrier who accepted them without reservation.
Orders are processed from Monday to Friday.
Your order will be prepared and shipped within 48 to 72 hours.
Regarding deliveries made outside of Martinique, the "Customer" agrees to pay all taxes due on the importation of the products delivered to them, including customs duties, value-added tax, and all other taxes payable under the laws of the country of receipt indicated during their order.
Update regarding shipping costs and customs duties
Shipping costs are calculated based on the total weight of the order, depending on the destination and the current postal rates. They will be updated in your shopping cart during checkout. Free shipping is offered for orders over €130, for mainland France and DOM-TOM only.
For mainland France, customs duties may be charged by the Post Office or the carrier upon delivery, as well as any handling fees directly managed by the carrier.
We are aware that this is an additional financial burden imposed on us by the French Administration.

7 - Transfer of ownership - Transfer of risk
Ownership of PARFUMS DES ILES products and the corresponding transfer of the risks of loss and deterioration shall be transferred upon payment of the order to our bank account by the Buyer, thus formalizing the agreement of the parties on the product(s) and the price, regardless of the date of payment and delivery. The products therefore travel at the seller's risk, who may, in the event of damage, make any claims to the carrier under the applicable legal and regulatory conditions.
8 - Order received
Upon receipt of your order, before signing the carrier's delivery receipt, unpack and inspect your product in the presence of the delivery person, even if the packaging is intact.
Do not sign under pressure from the delivery person. If they disagree, specify the reason on the delivery slip: "the delivery person did not wish to witness the unpacking during inspection of the package". This is your right and your only means of contesting any damage.
The valid reserves that can be used to obtain a product replacement are:
- In case of "X" damaged products, note "X damaged and refused products"
- In case of "X" missing products, note "X missing products"
The mention "subject to unpacking" is not a valid reservation and will not allow the product to be replaced.
If any reservations have been made on the delivery slip, please inform our customer service by email at contact@parfums-des-iles.com , who will open a claim file with the carrier.
9 - Data Protection
Data Collection and Use: We collect information about you to process your orders and provide you with the best possible service. The personal data you provide us is not shared with unauthorized third parties outside the company. However, we must share it with our approved delivery partners to fulfill your order.
The processing of information provided via the website www.parfums-des-iles.com, including the management of users' email addresses, has been declared to the CNIL (French data protection authority) and registered under number 2118600 v 00.
PARFUMS DES ILES reserves the right to send you product information and advertising from time to time by mail or email to the addresses provided during your order. You may, at any time, request the cessation of the processing and use of your personal data for advertising purposes. On the other hand, PARFUMS DES ILES does not have access to the customer's bank details.
Right of access, modification and deletion of your personal data: In accordance with the applicable law n° 78-17 of 6 January 1978 relating to data processing, data files and freedoms, as amended on 6 August 2004, you have the right to access, modify, rectify and delete information concerning you. You also have the right to object, for legitimate reasons, to the processing of this data. You can exercise these rights or request a paper copy of your data directly from customer service at contact@parfums-des-iles.com or by email, via the contact section of the website www.parfums-des-iles.com.

10 - Products
The products offered are produced in Martinique and distributed by the company PARFUMS DES ILES.
The products governed by these general terms and conditions are those listed on the website www.parfums-des-iles.com.
They are described and presented there with the utmost accuracy.
The product photographs are not contractually binding.
PARFUMS DES ILES reserves the right to add or remove products from its catalog at any time and without notice.
11 - Force majeure
All circumstances beyond the control of the parties that prevent the performance of their obligations under normal conditions are considered grounds for exemption from the parties' obligations and result in their suspension.
The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their disappearance.
All irresistible events or circumstances external to the parties, unforeseeable, unavoidable, independent of the parties' will, and which cannot be prevented by them despite all reasonably possible efforts, shall be considered as force majeure. Specifically, in addition to those usually recognized by the jurisprudence of French Courts and Tribunals, the following are considered as force majeure or fortuitous events: blockage of transport or supply means, earthquakes, fires, storms, floods, lightning strikes, the shutdown of telecommunication networks, or difficulties specific to telecommunication networks external to the clients.
The parties will meet to assess the impact of the event and agree on the conditions under which the contract will continue to be performed. If the force majeure event lasts longer than three months, these general terms and conditions may be terminated by the aggrieved party.

13 - Intellectual property
The content of this website, protected by French and international intellectual property laws, is the property of PARFUMS DES ILES. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement. All visuals and photographs visible on the Site, and in particular those representing and illustrating the Products, are necessarily protected by copyright and all other intellectual property rights and belong to the Seller or to third parties who have authorized PARFUMS DES ILES to exploit them. Any reproduction and/or exploitation of any kind whatsoever, without authorization, of the said visuals or photographs shown on the Site will be subject to legal action.
14 - Applicable Law
These general terms and conditions are governed by French law, to the exclusion of the provisions of the Vienna Convention. This applies to both substantive and procedural rules. In the event of a dispute or claim, the Buyer shall first contact the seller to seek an amicable solution.
15 - Partial non-validation
If one or more provisions of these general terms and conditions are held to be invalid or declared as such by virtue of a law, regulation or following a final decision of a competent court, the other provisions shall remain in full force and effect.
